EHCP - Failing to meet Deadlines



Another common story for Parent in the East Riding is regarding EHCP timescales with schools and L.A's seemingly (and unlawfully) able to go over these but of course the same flexibility not offered to parents/carers and all the while not benefiting the child:



"My son's EHCP was completed in 2020, I had an annual review meeting the following March, after lots of discussion and the summer holidays I got a draft from school that I was finally happy with which was sent to the LA, I never got a response. I had a review Feb 2022, I got a draft from school in April after the Easter Break, once discussed and a draft agreed it was sent to the LA in May, I chased this up once I got to four weeks and was told it was going to be amended. I chased again once we got to 8 weeks and had received no draft, it was a week after due to back log and quality assuring it that I received it.


I have sent back pages of queries over things been taken out including needs highlighted in a SALT assessment, and most things change to Education setting and daily or weekly, it seems some of the specifics have been removed. I'm already six months after his review and still no final plan, and I feel it's going to be a while yet until it's agreed. It's so frustrating, and it hardly seems fair that schools and the LA can go over the timeframes and it doesn't seem to matter, but parent/carers get 15 days no matter how busy our lives are (have more than one child with SEND) and that's it, issued because it's a legal deadline."
